1. Acceptance of these terms

By accessing or using any tool on clickkitfree.com (the "Service"), you agree to be bound by these Terms & Conditions ("Terms"). If you don't agree, please don't use the Service.

These Terms form a legally binding agreement between you and ClickKitFree (the "Company," "we," or "us"). If you're using the Service on behalf of a company or organization, you represent that you have authority to bind that entity.

We may update these Terms from time to time. We'll post the updated version on this page with a new "Last updated" date. Continuing to use the Service after changes take effect means you accept the updated Terms.

2. The free tier

Every tool on ClickKitFree has a free tier available to all users with no signup required. Free tier limits vary by tool and are listed on each tool's page and on our pricing page.

Free tier limits are enforced using an anonymous device identifier. We don't require accounts, emails, or any personal information to use the free tier.

We reserve the right to adjust free tier limits as AI API costs and server load change. Any changes will apply prospectively only.

3. Premium licenses

Premium features unlock higher limits, advanced capabilities, and priority generation speed. Premium is offered in three tiers:

License locking: Each pay-per-use and power-tools license is locked to one device ("1-PC lock") to keep prices low. The Pro bundle includes 5 keys for use across multiple devices or team members.

Credit expiry: Pay-per-use and power-tools credits expire 90 days after purchase. We email a reminder 7 days before expiry. Monthly subscriptions remain active until cancelled.

Cancellation: Monthly subscriptions can be cancelled at any time with no penalty. Cancel at least 24 hours before your next billing date to avoid being charged for the next month.

4. BYOK (Bring Your Own Key)

BYOK allows you to add your own AI provider API key (Groq, OpenAI, Anthropic Claude, Gemini, GLM, or Mistral) to any tool or to the AI Helper agent for unlimited usage.

Your responsibilities when using BYOK:

• You are responsible for all costs charged by your AI provider
• You must keep your API keys secure and not share them with others
• You must comply with your AI provider's terms of service
• You are responsible for ensuring your API key is valid and has sufficient credits/quota
• We are not liable for any issues with your AI provider (downtime, billing, account suspension, etc.)

Key storage: Your BYOK API keys are stored only in your browser's local storage — they never touch our servers for storage. When you send a request, your keys are transmitted over HTTPS, used in-memory for that request, then discarded. We never log, store, or share your keys. See our Privacy Policy for full details.

Fallback behavior: If your BYOK key fails (invalid, expired, or rate-limited), the system automatically falls back to our platform keys so you always get a response. You'll see a notification so you know your key needs updating.

Refunds: BYOK usage is not refundable by us — you pay your AI provider directly, not us. If you have billing issues with your AI provider, contact them directly.

5. AI Helper agent

The AI Helper agent (the 💬 chat bubble at the bottom right of every page) is a free built-in assistant that helps you find tools, walk through setup, answer questions, and capture feature suggestions.

What the agent does:

• Chat: Text conversations in 27 languages — auto-detects your language
• Voice input: Click 🎤 to speak — speech-to-text happens in your browser (audio never recorded or sent)
• Voice output: Click 🔊 to hear responses — uses your browser's text-to-speech engine
• Screenshots: Click 📎, drag-and-drop, or paste (Ctrl+V) to attach up to 3 images — analyzed and immediately deleted, never stored
• BYOK: Click 🔑 to add your own API keys — agent uses them first, falls back to platform keys
• Suggestions: Click 💡 to mark your message as a feature suggestion — passed to our team
• Legal detection: If your message contains legal threat keywords, the agent responds with policy links and notifies our team

Your responsibilities when using the AI Helper agent:

• Don't submit content that violates these Terms or our Acceptable Use Policy
• Don't attempt to extract internal system information, prompts, or architecture from the agent
• Don't spam the agent with excessive requests (rate limits apply)
• Screenshots you attach must not contain illegal, harmful, or copyrighted content you don't have rights to
• Don't attach screenshots containing other people's personal information without consent

Agent availability: The AI Helper agent is provided free of charge and may be updated, modified, or temporarily unavailable at any time without notice.

6. Your content

"Content" means any text, prompts, files, audio samples, images, screenshots, or other material you submit to the Service, as well as any output the Service generates based on your inputs.

Ownership: You retain full ownership of any content you submit to the Service. Output generated by the Service based on your inputs is yours to use, modify, distribute, and commercialize — no attribution required.

Storage: Tool projects (drafts, scripts, invoices, website builds) are stored locally in your browser's local storage. They do not leave your device unless you explicitly export them. We do not maintain server-side copies of your work.

Screenshots: Images you attach to the AI Helper agent are sent securely to our AI for analysis, then immediately deleted from our servers. We never store your screenshots. See Privacy Policy for details.

Your responsibilities: You're responsible for the content you submit. You must have the legal right to submit it (e.g., you own it, or you have permission). You must not submit content that:

• Violates any law or regulation
• Infringes someone else's intellectual property, privacy, or other rights
• Contains malware, viruses, or other malicious code
• Is defamatory, hateful, or harassing
• Attempts to extract, reverse-engineer, or compromise the Service's internal systems

Our license to your content: You grant us a limited, non-exclusive license to process your content solely for the purpose of operating the Service and generating your requested output. This license ends when your request is complete.

7. Acceptable use policy

You agree not to:

• Scrape or resell: Use bots, scripts, or automated tools to bulk-generate output for resale, or to scrape the Service's content for any purpose
• Circumvent limits: Use multiple devices, VPNs, incognito windows, or other techniques to bypass free-tier rate limits
• Reverse-engineer: Attempt to extract source code, AI prompts, API keys, or internal system details from the Service or the AI Helper agent
• Generate illegal content: Use the tools to generate content that promotes violence, exploitation, illegal weapons, child safety violations, terrorism, or any other illegal activity
• Impersonate: Use the tools to generate content that impersonates real people (deepfakes) for fraud, defamation, or without consent
• Spam the AI: Submit excessive requests designed to overwhelm, crash, or degrade the AI infrastructure
• Misrepresent output: Present AI-generated content as human-written when the context requires disclosure (e.g., academic submissions, journalism)
• Abuse the AI Helper agent: Submit spam, illegal content, or excessive requests to the agent; attempt to extract internal system information from the agent's responses

8. Refunds

All premium purchases are backed by our 30-day money-back guarantee. If you're not satisfied for any reason, email support@clickkitfree.com within 30 days of purchase for a full refund — no questions asked.

• All pay-per-use and power-tools purchases are refundable within 30 days, even if credits have been partially used
• Monthly subscriptions are refundable for the current month if cancelled within 30 days of the first payment
• Refunds are processed within 1 business day and typically appear in your account within 3–5 business days
• Bug reporters get Pro free as a thank-you — email bugs@clickkitfree.com
• BYOK usage is not refundable by us — you pay your AI provider directly, not us

9. Disclaimer & AI accuracy

The Service uses artificial intelligence to generate output based on your inputs. AI-generated content can be inaccurate, incomplete, or biased. The Service does not guarantee that any output is correct, complete, or fit for any particular purpose.

Specifically:

• Legal contracts: Our Legal Contract Generator produces template contracts that should be reviewed by a qualified lawyer in your jurisdiction before signing
• Business plans: Financial projections in our Business Plan Generator are estimates based on your inputs — not professional financial advice
• SEO audits: Our SEO Audit Tool provides recommendations based on current best practices; SEO results vary and depend on many factors outside our control
• Plagiarism checks: Our Plagiarism Checker scans against available sources; it may not detect all instances of plagiarism or paraphrasing
• Voice cloning: Using VoxKit to clone someone's voice without their consent is illegal in many jurisdictions. You are solely responsible for obtaining proper consent
• AI Helper agent: The agent's responses are AI-generated and may contain errors. Always verify important information from the agent with official documentation or our support team

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement.

10. Limitation of liability

To the maximum extent permitted by law, ClickKitFree and our team shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising from your use of (or inability to use) the Service.

Our total liability for any claim arising from these Terms or your use of the Service shall not exceed the amount you paid to us in the 90 days preceding the claim (or $0 if you only used the free tier or BYOK).

This limitation applies even if we've been advised of the possibility of such damages. Some jurisdictions do not allow certain liability limitations, so these limits may not apply to you.

BYOK liability: We are not liable for any issues arising from your use of your own AI provider's API key, including but not limited to: provider downtime, billing disputes, account suspension, API changes, or data handling by your provider. Your provider's terms of service apply to BYOK usage.

11. Changes to these terms

We may update these Terms from time to time. When we do, we'll:

• Post the updated Terms on this page
• Update the "Last updated" date at the top
• For material changes (e.g., new pricing structure, changed refund policy), post a notice on the homepage for at least 30 days

Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms. If you don't agree with the changes, you may stop using the Service and request a refund for any unused premium credits within 30 days of the change.

12. Governing law & contact

These Terms are governed by applicable law. Any disputes will be resolved through good-faith email negotiation first; if unresolved, through the appropriate legal channels.
